Terms of Service

By downloading, installing, or using AssetlyBar (the "App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you and Jakub Štellner ("we," "us," or "our"), the developer and operator of AssetlyBar.

AssetlyBar is a macOS menu bar application that provides:

• Real-time stock and cryptocurrency price tracking
• Portfolio management and performance tracking
• Customizable watchlists
• Menu bar integration for quick access

The App is available in two tiers: Free (limited features) and Pro (subscription-based, full features).

3.1 Free Tier

The free version of AssetlyBar allows you to track up to 10 stocks, unlimited cryptocurrencies, and basic portfolio tracking. No account creation is required for free tier usage.

3.2 Pro Subscription

AssetlyBar Pro is available as a monthly ($2.99/month) or yearly ($19.99/year) subscription purchased through the Apple App Store. By subscribing, you agree to:

• Automatic renewal unless you cancel at least 24 hours before the end of the current period
• Payment charged to your Apple ID account upon confirmation of purchase
• Apple's standard subscription terms and refund policies apply

3.3 Cancellation

You may cancel your Pro subscription at any time through your Apple ID account settings. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial periods.

You agree to use AssetlyBar only for lawful purposes. You must NOT:

• Use the App to engage in illegal activities or violate securities laws
• Reverse engineer, decompile, or attempt to extract the source code
• Abuse, overload, or disrupt the App's servers or infrastructure
• Scrape, harvest, or collect data from the App using automated means
• Circumvent or attempt to bypass Pro subscription restrictions
• Share your Pro subscription with others or use it on unauthorized devices
• Redistribute, resell, or sublicense the App without permission

Violation of these terms may result in immediate termination of your access to the App.

5.1 Data Provided "As Is"

AssetlyBar displays stock and cryptocurrency prices from third-party data providers. While we strive for accuracy, we cannot guarantee that all data is error-free, complete, or up-to-date at all times.

5.2 Not Financial Advice

IMPORTANT: AssetlyBar is a tool for tracking and monitoring only. It does NOT provide financial, investment, tax, or legal advice.

• Do not make investment decisions based solely on data displayed in the App
• Always consult a licensed financial advisor before investing
• Past performance does not indicate future results
• Cryptocurrency and stock investments carry risk of loss

5.3 No Trading Execution

AssetlyBar does not execute trades, connect to brokerage accounts, or handle real money. It is purely an informational and tracking tool.

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• We are not liable for any financial losses, missed opportunities, or investment decisions made based on data displayed in the App
• We are not responsible for third-party data provider errors, delays, or outages
• We are not liable for data loss due to device failure, iCloud issues, or user error
• Our total liability for any claim shall not exceed the amount you paid for your Pro subscription in the last 12 months (or $0 for free users)

The App is provided "AS IS" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

7.1 Ownership

AssetlyBar, including its design, code, trademarks, and all intellectual property, is owned by Jakub Štellner. Your subscription grants you a limited, non-exclusive, non-transferable license to use the App.

7.2 Your Data

You retain ownership of all portfolio data, watchlists, and information you enter into the App. We do not claim ownership of your personal data.

AssetlyBar integrates with third-party services for market data, payments (Apple), and optional cloud sync (iCloud). These services have their own terms of service:

• Apple App Store: Standard EULA
• Market data providers: Subject to their respective terms

We are not responsible for the availability, accuracy, or terms of third-party services.

9.1 App Updates

We may release updates to improve functionality, fix bugs, or add new features. Some updates may be required to continue using the App.

9.2 Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes via:

• Email (if you have a Pro subscription)
• In-app notification
• Updated "Last updated" date on this page

Continued use of the App after changes constitutes acceptance of the new Terms.

9.3 Service Discontinuation

We reserve the right to discontinue AssetlyBar at any time. In such cases, Pro subscribers will receive a prorated refund for unused subscription time.

Your use of AssetlyBar is also governed by our Privacy Policy. Please review it to understand how we collect, use, and protect your information.

11.1 By You

You may stop using the App at any time by deleting it from your Mac and canceling your Pro subscription (if applicable).

11.2 By Us

We may suspend or terminate your access to the App if you:

• Violate these Terms
• Engage in fraudulent or abusive behavior
• Fail to pay subscription fees (payment failures)

Upon termination, your right to use the App immediately ceases. Locally stored data may remain on your device unless you delete the App.

You agree to indemnify and hold harmless Jakub Štellner from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your use or misuse of the App
• Your violation of these Terms
• Your violation of any applicable laws or regulations
• Investment decisions made using data from the App

13.1 Governing Law

These Terms are governed by the laws of the Czech Republic and the European Union, without regard to conflict of law principles.

13.2 Dispute Resolution

If you have a dispute, please contact us at support@assetlybar.com to attempt informal resolution first.

For unresolved disputes, you agree to submit to the exclusive jurisdiction of courts in the Czech Republic.

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Jakub Štellner regarding AssetlyBar and supersede all prior agreements or understandings.
